Confederate Soldier.  Pvt. Co A, 29th NC Infantry - enlisted 17Jun1861 in Cherokee Co, NC
 
He lived at and operated a toll gate near Deal's Gap.  Historic Marker 1E-37 reads as follows:  Early Tollgate - The chimney nearby marks the location of a tollhouse on the Tennessee River Turnpike, which operated in 1829.  Connecting Blount Co, TN with Macon Co, NC across the Great Smokies, it was an important route in livestock commerce between production centers in GA and the east TN region.

 Notes for William W. Williams , Sr.:
Buried at Yellow Creek Cemetery; nr. Tapoco, NC.  He was traveling to his son, William's home on a mare.  The mare was frightened by some knives, spoons, and forks that he was carrying.  The mare passed under a low limb on a tree, such that William's head struck the branch and he was killed.

I, Jesse Millsaps, do make and publish this my last will and testament hereby revoking and making void all other wills by me at any time made.
 
1st, I direct that my funeral expenses and all my dets be paid as soon after my death as possible out of any money that I may die possessed of or may come to the hands of my executors.
 
2nd, I give and bequeath to my beloved wife Polly Millsaps my estate real and personal during her life or widowhood and in case of second mariage the real estate then immediately to descent to my youngest son John E. Millsaps, as is intended by this my last will and testament.
 
3rd, I direct and allow my wife to give to my youngest daughter, Ludesa, any species of property and to the extent she may think proper.
 
4th, I hereby enjoin on my son John E. Millsaps to live and remain on the farm where he now lives to superintend and take care of his mother and at her death take possession of the premises.
 
5th, After the death of my wife my personal property to be equally divided between my daughters, towit:  Elizabeth, Trifina, Jemina, Polly, Jane, and Rebecca.  Ludesa first being provided for by her mother.
 
6th, To Have this my last will fully understood at the death of my wife, I bequeath my real estate to my son John E. Millsaps.
 
7th and Last, I do hereby nominate and appoint my wife, Polly Millsaps, and John E. Millsaps my executors.  In witness whereof, I do this my will set my hand and seal this 8th day of May 1845.

Samuel Yates / Jane Millsaps Bible Record
This Bible record was included in the pension record of Samuel Yates who 
served out of NC during the Rev. War. #R11927. He was born Aug. 24, 
1757, joined the service in Nash Co. NC and died Apr. 18, 1844. His 
widow applied for pension from Cocke Co. Tn. in 1846 at age 87., 
therefore born ca. 1759. She md. Samuel Yates Jan. 1787 in Burke Co. NC. 
The Bible was copied for the purpose of applying for pension, because 
the original was in such poor shape. The corner was torn from the pages 
as a man named Ford wanted to use the births of two of the girls to 
apply for pension on behalf of his mother. Jesse Millsaps of Monroe Co. 
Tn. was illegitimate son of Jane Millsaps. It goes as follows:

        55.  Elizabeth Woods, born 1745 in Frederick, VA; died January 03, 1841 in Carter Co, TN.  She was the daughter of 110. James Woods and 111. Elizabeth.
 
 Notes for Michael Hyder:
He signed the Halifax Petition of 1776. He was a member of the Watauga 
Assoc. He was in Ft. Watauga with his family on Jul. 21, 1776, when the 
Cherokee Indians attacked the fort. He was with John Sevier in almost 
all his expeditions against the Indians and the British, including the 
Battle of Musgrove's Mill in SC Thickety Fort and Cedar Springs. He was 
asked to stay behind and defend the fort when the men left to fight Maj. 
Patrick Ferguson at the Battle of King's Mtn. in SC. The militiamen had 
not been away long before Sevier received word from Hyder that an Indian 
party was on their way from the south to attack the settlement. The 
overmountain men headed west and met the war party at Boyd's Creek near 
presend day Sevier Co., Tn. just west of Knoxville. The Indians were 
soundly defeated. He had one of the first powder mills in the area. 
Powder from the mill was used at King's Mtn. His will dated 20 May 1790.
 
Came to the Watauge Settlement from Hampshire Co, VA in about 1767.  He is buried at Hyder Cemetery; Carter Co, TN.   Revolutionary Soldier - was at the Battle of Kings Mountain.

Will of Thomas Milsaps 
In the name of God Amen, the thirtieth day of October in the year of our 
Lord 1759 I Thomas Millsaps of Augusta County & Colony of Virginia being 
sick & weak in body but of perfect mind and memory thanks be given unto 
God therefore calling to mind the mortality of my body and knowing that 
is is appointed for all men one to die do make make and ordain this my 
last will and testament that is to say principally and first of all I 
give and recommend my soul into the hands of God that gave it and for my 
body I recommend to the Earth to be buried in a Christian like manner at 
the discretion of my Executors nothing doubting but at the general 
Resurection I shall receive the same again by the mighty power of God 
and as touching with worldly estate wherewith it hath pleased God to 
bless me in this life I give, devise and dispose of the same in the 
following manner and form. 
Imprimis it is my will and I do order in the first place all my just 
debts and funeral chanrges be paid and satisfied. Item: my will is and I 
do order that my well beloved wife Mary Millsaps shall have her equal 
share of moveables with the rest of my children hereafter named and the 
benefit of the house I now live in and the field and garden that is 
joyning to the house during her widowhood. Item: my will is and I do 
order that my son Robert Milsaps and Thomas Milsaps and my daughters 
Eliner Milsaps and Mary Milsaps shall have their equal shares of my 
moveables.  Item my will is and I do order that my daughter Jean Macgee
 shall have five shillings sterling my will is I do order that my 
daughter Elizabeth Dillen have her part of the moveables. Item by will 
is and I do order that my son Joseph Milsaps and my son William Milsaps
 shall have my land equally divided between them and my son Joseph shall 
have that part of my land that is called Robins__ Cabbin and joyning on 
William Carrols land and on my land line to him his heirs and assignees 
forever and likewise his part of the moveables. Item my will is and I do 
order that my son William Milsaps shall have the other part of my my 
land where I now live to him his heirs and assignees forever only that 
my wife shall have that part of it as is above mentioned to her during 
her widowhood or life and then my son William shall have it and the 
other part of my improvement to be ____ out for the benefit of my said 
son William til he come of age and his part of the moveables and 
likewise constitute, make and ordain my trusty friend Andrew Bird and my 
well beloved wife Mary Milsaps my executor & executrix of this my last

other former testaments, wills, legacys and executors by me before this 
time named ratifying and confirming this and no other to be my last will 
and testament in witness whereof I have hereunto set my hand and seal

and declared by this Thomas Milsaps as his last will and testament in 
the presence of us the subscribers. Note that before signing & sealing 
my will is ordered that my son William Milsaps shall pay to his two 
sisters Eliner & Mary Milsaps those pounds to each of them out of the

thereof in due form they having with Mounce? Bird and William Mcgee
